These Terms and Conditions apply to all purchases made through our website performancedelta.co.uk and form the basis of the contract between you (the “Buyer”) and Performance Delta Ltd (the “Company”, “Seller”, “we”, “us”). By using our website or placing an order, you agree to be bound by these terms.
We recommend printing or saving a copy for your records. Please also review our Privacy Policy for how we handle your data.
1. Definitions
Performance Delta Ltd / the Company / we / us refers to Performance Delta Ltd, United Kingdom.
Where a Buyer is purchasing in the course of a trade, profession, motorsport business, or specialist use, the Buyer shall be considered a Trade Buyer. Where a Buyer purchases as a private consumer, statutory consumer rights apply and are unaffected.
We reserve the right to update these Terms & Conditions at any time. The version displayed at the time of purchase applies.
2. Orders & Contract Formation
2.1. Placing an order constitutes an offer to purchase Goods in accordance with these Terms.
2.2. After submitting an order, you will receive an order acknowledgment email. This is not confirmation of acceptance.
2.3. Your order is accepted, and a legally binding contract is formed, when your order is dispatched.
2.4. If we cannot fulfil your order, we will notify you and issue a full refund where payment has already been taken.
3. Product Information
3.1. Product descriptions, specifications, images and measurements are provided in good faith but are for general guidance only.
3.2. Manufacturers may change specifications without notice to improve product performance.
3.3. It is your responsibility to verify compatibility with your vehicle before ordering, especially where modifications have been made.
4. Prices & Payment
4.1. Prices are shown in GBP and include VAT where applicable.
4.2. Payment is taken at the time of order.
4.3. We accept Credit/Debit Card and PayPal.
4.4. If a pricing error is discovered, we will contact you before dispatch and offer the choice to continue at the corrected price or cancel the order.
5. Delivery
5.1. Delivery charges and options are displayed at checkout.
5.2. Estimated delivery times are provided as guidance only. Delays may occur due to factors outside our control.
5.3. Risk in the Goods passes to you on delivery or the first attempted delivery.
5.4. Orders are typically dispatched once all items are in stock.
6. Inspection on Delivery
6.1. You must notify us in writing of any shortages, damage or incorrect items within 7 days of delivery.
6.2. Packaging must be retained for claims processing.
7. Warranty & Performance Use
7.1. Manufacturer warranties apply to products where supplied.
7.2. Motorsport, track and competition use subjects components to extreme stress. Life expectancy is reduced and failures are more likely.
7.3. No warranty is offered for failures where Goods are:
Used in motorsport or competition environments,
Installed incorrectly,
Modified after delivery.
7.4. Certain components may cause accelerated wear or changes to related systems (e.g., brake, clutch, suspension geometry). The Buyer accepts full responsibility for assessing suitability and safety.
8. Liability
8.1. Nothing excludes liability for death or personal injury caused by negligence or fraud.

9. Cancellation & Returns
Consumers (distance purchases)
9.1. You may cancel your order within 14 days of receiving the Goods.
9.2. Goods must be returned unused, uninstalled, in original packaging and at the Buyer’s cost.
9.3. Refunds are issued within 30 days of return inspection.

10. Title
Ownership of Goods remains with Performance Delta Ltd until full payment is received.
11. Force Majeure
We are not liable for delays or failure to supply caused by events outside our control (e.g., logistics issues, strikes, weather, supply chain issues).
12. Intellectual Property
Images, branding and product content on our website remain the property of Performance Delta Ltd and must not be reproduced without permission.
13. Jurisdiction
These Terms are governed by English law and disputes will be resolved in the courts of England and Wales.
14. Promotions
Promotions may be withdrawn at any time.
Discount codes cannot be combined unless explicitly stated.
Discounts cannot be applied retrospectively.
